Welcome to Niccolai's B2B Portal

By using this Business to Business Portal and its pages:

1. you agree to these terms and conditions of use (Terms); and
2. where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms on that person's behalf and that by agreeing to these Terms on that person's behalf, that person is bound by these Terms.

Any user that does not agree to these Terms is not authorised to access and use the portal and must immediately cease doing so.

We may amend these Terms in whole or in part from time to time.
Amendments will be effective immediately when we post the amended Terms on the portal.
You are responsible for ensuring that you are familiar with the latest Terms.

By continuing to use the website, you agree to be bound by the Terms as amended (whether or not you have reviewed any amendments).

The term ‘Niccolai’ or ‘us’ or ‘we’ refers to the owner of the website whose registered office is 31 O'Sullivan Avenue, Maroubra, NSW. Our ABN is 59 637 637 355.

The term ‘you’ refers to the user or viewer of our website.

The use of this website is subject to the following terms of use:

★1. eCommerce

No agreement is formed with a customer until an order has been accepted and processed, and an order confirmation has been sent. Stock issues or technical glitches can happen from time to time.

★2. Payment

We are welcoming:

Credit cards accepted          no commissions

Accounts are to be paid in full within 30 days from the invoice date.

★3. Freight

NSW, ACT, Melbourne Metropolitan and Brisbane Metropolitan

Orders over $1,200 pre GST - prepaid (FIS)
Orders under $1,200 pre GST - freight collect

All other VIC destinations, Adelaide Metropolitan, Gold Coast, Sunshine Coast, Bundaberg, Rockhampton and Toowoomba

Orders over $1,500 pre GST - prepaid (FIS)
Orders under $1,500 pre GST - freight collect

North QLD, Hobart, Launceston, Devonport, Perth Metropolitan and Darwin Metropolitan

Orders over $2,000 pre GST - prepaid (FIS)
Orders under $2,000 pre GST - freight collect

The above minimum order value are to be calculated excluding GST.

★4. Free in Store (FIS) Freight

The FIS - Free in Store value is based on available, shippable stock. Any items that are not in stock or not available will not be included in the FIS value.

★5. Drop Ship

We do Drop Ship directly to the end users. Please specify before the order has been sent.
Any extra costs regarding the receiving without forklifts will be invoiced to the distributor.

★6. Returns and Refunds

No returns will be accepted without the prior written consent of Niccolai Imports. 
All good returned to Niccolai Imports MUST have a RUN (Return Authority Number), or good will not be accepted for return.
All good must be returned unused in their original, unmarked packaging and freight prepaid to the nominated Niccolai warehouse.

Returns, if accepted, will be subject to the following restocking fees and any freight incurred in either the return or original dispatch of goods.

Return goods less than 1 month old - 10% restocking fee
Return goods less than 3 months old and more than 1 month old - 20% restocking fee
Return goods over 3 months old - 30% restocking fee.

A credit note as a refund will be raise in 10 days.

★7. Pricing 

Prices on the website are GST excluded 

Niccolai Pty Ltd reserves the right to amend prices at any time without notice.

★8. Minimum Orders

Orders under $250 of shippable stock pre GST will incur an Administration charge of $20.00 plus GST.

★9. Bespoke and Indent orders 

Stock made to a customer's special order or purchased as an indent order will not accepted for exchange or return.

★10. Damages and Shortages 

All goods delivered to the buyer shall, to the extent permitted by law, be deemed to have been received by the buyer in good order and condition and in accordance with any applicable specifications as soon as the goods have been accepted by the buyer, its carrier or agent.

Goods that are damaged in transit must be claimed immediately with the carrier.

Over supply or shortage of pallets or cartons must be noted on the freight consignment note at the time of signing.

Crockery and glass products should be checked immediately.

Written notification of damage given to Niccolai Pty Ltd in writing within 5 days of receipt of the goods. The product must be returned unused within 30 days of receipt of your order.

Non-custom products will be accepted for a return or refund only with prior authorisation.

There is no liability for Niccolai if goods have been picked up or freight is arranged by customer. 

★11. Tax 

Goods and Service Tax (GST) will be charged in addition to our prices.

★12. Backorders 

The minimum FIS applies to backorders. 

If backorders that have come into stock do not reach the minimum FIS, they will be shipped with the next order. All backorders will be supplied unless cancelled and will not be accepted for return.

★13. Intellectual Propriety 

This website may contain links to other websites owned by non-affiliated entities and we may display advertisements from third parties on our website. When you click on these links, you enter another website. Those websites are not under our control. The links are provided for convenience and informational purposes only.

Accordingly, the inclusion of any link does not imply an endorsement by us of that website. We are not responsible for the content, validity, accuracy, or the use of any other website. You should check the terms and conditions applicable to any other websites you use or verify such information with the third parties directly.

The parties agree to submit to and be bound by the laws and courts in the State of New South Wales.
